In a move that has sparked controversy and raised questions about democracy, American lawmakers have recently taken steps to ban the popular social media platform TikTok. Simultaneously, they have reauthorized the Foreign Intelligence Surveillance Act (FISA) for another two years, allowing the US government to obtain digital communications of foreigners overseas without a warrant.

The heightened concern over TikTok's data sharing with the Chinese government, compared to relatively less public controversy around American tech companies sharing data with foreign governments, primarily stems from national security and geopolitical factors, and the legal frameworks governing data sharing.

TikTok, owned by China-based ByteDance, has drawn intense scrutiny due to fears that data collected on US users could be accessed or requested by the Chinese government under Chinese laws that compel companies to cooperate with intelligence agencies. This presents a direct national security risk perceived by many US politicians, leading to targeted legislative and regulatory actions against TikTok specifically.

On the other hand, American companies often operate under US laws like the Cloud Act, which governs how data is shared with lawful requests from allied foreign governments (e.g., the UK) for law enforcement purposes. While this sometimes involves sharing data with foreign governments, it is viewed distinctly from adversarial data sharing, with oversight and usually aligned with US legal and security interests.

The US government has identified certain countries, including China, as "foreign adversaries." It has enacted specific regulations such as the Protecting Americans’ Data from Foreign Adversaries Act (PADFA) of 2024 and the Bulk Data Transfer Rule (Executive Order 14117) that restrict bulk transfer of sensitive US data to adversary countries like China, Russia, Iran, and North Korea. These laws reflect significant concern about foreign governments, particularly China, exploiting American data for espionage or surveillance.

The proposed TikTok ban follows a foreign-owned social media platform giving a megaphone to victims of US imperial policy, leading to a shift in American support for US policy in the Middle East. Young people, in particular, are more likely to sympathise with Palestinians than Israelis due to the impact of foreign social media platforms like TikTok. This has raised concerns among US lawmakers about the potential influence of foreign entities on American public opinion.

Meanwhile, more than half of the requests made by foreign governments for user data by American tech companies are categorised as emergency disclosure requests. The Israeli government, for instance, made 1,088 requests of Meta between January and June 2023.
